GUARANTEE AND TECHNICAL ASSISTANCE

The purchase of the Valiryo® body dryer is covered by a two-year legal guarantee against non-conformities in accordance with the terms of the General Consumer and User Protection Law (Royal Legislative Decree 1/2007).

Any operating defect in relation to the Valiryo® will entitle the consumer to the the free replacement of the product with another of identical characteristics within a period of no greater than 30 days. The expenses involved in the dispatch or collection of both the product to be replaced and the replacement product are covered in national territory (Spain). In order to deal with any incident in connection with the malfunctioning or state of the product, the consumer should contact the Valiryo® technical assistance department via the telephone number, e-mail or postal address provided for the purpose. A preliminary assessment of the product will be conducted via electronic means, and if this fails to resolve the issue arrangements will be made to deliver or collect the product for review.

LEGAL GUARANTEE

The purchase of the Valiryo® body dryer, is covered by a two-year legal guarantee against non-conformities in accordance with the terms of the General Consumer and User Protection Law (Royal Legislative Decree 1/2007).

In accordance with articles 114 - 124 of the aforementioned General Consumer and User Protection Law, consumers will have, among others, and subject to compliance with legal requirements, the right to the free replacement by the manufacturer of any product with a non-conformity within the 24 months subsequent to delivery, provided the non-conformity existed at the time the product was delivered. Unless proved otherwise, any non-conformity arising during the first six months subsequent to delivery will be presumed to have existed at the time of delivery, except when this assumption is incompatible with the nature of the product or the type of non-conformity.

Conditions for replacement

Any product revealing a non-conformity in the 24 months subsequent to delivery will be replaced by another of identical characteristics with a period of 30 days.

The expenses involved in the dispatch or collection of both the product to be replaced and the replacement product are covered in national territory (Spain).

Non-conformities

In accordance with article 116 of the General Consumer and User Protection Law, a product possesses a non-conformity if that product:

  1. Is not suitable for the uses for which products of the same type are intended.
  2. Fails to meet the description provided by the seller and does not possess the product qualities the seller declared to the consumer when presenting the sample or model.
  3. Does not feature the quality and performance common to a product of the same type and clearly expected by the consumer or user, given la nature of the product, and, where applicable, the public declarations in relation to the specific characteristics of the products marketed by the seller, manufacturer or representative of the same, in particular with regard to advertising or specified on the product label.
  4. Is unsuitable for any special use required by the consumer and made known to the seller at the time of entering into the agreement, provided the seller has stated that the product serves for such a use.

The guarantee does not cover non-conformities which have been caused by the improper use of the product by the consumer. Improper use of the product includes:

  • Defects caused by the improper use of the appliance such as:
    • Electrical power connection other than 220/230 V, ~50/60 Hz
    • Partial or total blockage of the air outlets by means of the air vents
    • The insertion of objects inside the column via the vents
    • The insertion of paper or objects in the housing via the air suction openings
    • Impact, or hanging items from the dryer
  • Removal of the sticker with the model number
  • Partial or total modification of the equipment

Management of non-conformities

The consumer may claim from the seller of the product legal guarantee rights in relation to non-conformities existing at the time of delivery or which arise within a period of 24 months of the same.

Consumers may make use of the legal guarantee whenever proof of the purchase of the product is provided (an invoice or receipt of sale, for example).

In order to deal with any incident in connection with the malfunctioning or state of the product, the consumer should contact the Valiryo® technical assistance department via the telephone number, e-mail or postal address provided for the purpose. A preliminary assessment of the product will be conducted via electronic means, and if this fails to resolve the issue arrangements will be made to deliver or collect the product for review on the seller´s premises.

Once it has been ascertained that all the conditions specified by the General Consumer and User Protection Law have been met, the consumer will be entitled to the free replacement of the non-conforming product, except in the event the form of remedy requested by the consumer is objectively impossible or disproportionate in comparison with the other, given the value of the product, the nature of the non-conformity and the possibility of implementing an alternative form of remedy at no great inconvenience to the consumer.

In the event the replacement of the product is impossible, fails to deal with the non-conformity of the same, or has not been concluded within a reasonable period of time or at no great inconvenience to the consumer, then the consumer will have the right to terminate the purchase agreement and to be reimbursed for the full price of the purchase (subject to returning the product) or request a reduction in the purchase price. The reduction in price shall be proportionate to the difference between the value of the product at the time of delivery if it had been in accordance with the agreement, and the value of the product actually delivered at the time.

If the assessment determines that the conditions set forth in the General Consumer and User Protection Law have not been met (for example, that the defect has been caused by the improper use of the product), the Valiryo® Technical Department will contact the consumer to inform him of the nature of the defect and the estimated cost of repair. These costs will be borne by the consumer in full. Furthermore, in certain cases the consumer may be asked to pay the cost of the analysis conducted which revealed no non-conformity whatsoever. Any consumer found to be at fault will not receive a replacement product.

Right of withdrawal: 14 days.

LEGAL RIGHT

You may withdraw from your order for no reason within 14 calendar days of the day on which you or a third party you have indicated (other than the carrier) receives the purchased items.

As such, you should inform us of your decision to withdraw from your order by contacting the Valiryo® technical assistance department via the telephone number, e-mail or postal address provided for the purpose.

EFFECTS OF WITHDRAWAL

Lifeak will reimburse you for the price of the product within 30 calendar days of the date on which we receive the aforementioned notification. Lifeak will use the same means of payment you used in the initial transaction, unless another means is specifically agreed upon. We may withhold the reimbursement until we have received the goods you have returned or until you provide us with proof of having returned the goods, in accordance with whichever is concluded first.

It should be pointed out that you should return the goods within14 days of notifying us of your withdrawal. You should bear the direct costs of returning the goods in question and will be responsible for the reduced value of the goods due to having handled the same (except when such handling is necessary to ascertain the nature, characteristics and functioning of the goods).
